Welcome to Wines Underwater. These Terms of Service ("Terms") govern your use of our website, www.winesunderwater.com (the "Site"), and the purchase of our products. By accessing or using our Site, you agree to these Terms. If you do not agree, please do not use our services.

1. General Terms
1.1. Wines Underwater is an online retailer specializing in underwater-aged wines. All purchases are subject to availability.
1.2. You must be of legal drinking age in your country of residence to purchase our products.
1.3. We reserve the right to modify these Terms at any time. Continued use of the Site constitutes acceptance of the revised Terms.

2. Orders & Payments
2.1. All orders are subject to acceptance and availability.
2.2. Prices are listed in Euro and include applicable taxes unless otherwise stated.
2.3. Payment must be made at the time of purchase via the available payment methods. 2.4. We reserve the right to cancel any order if fraudulent activity is suspected.

3. Shipping & Delivery
3.1. We ship to select countries. Shipping restrictions apply.
3.2. Orders are processed and shipped via our courier partners, including GLS and UPS 3.3. Delivery times are estimates and may vary due to external factors.
3.4. Customers are responsible for any customs duties or import taxes applicable in their country. 

Alcohol Shipping Compliance:
We ship alcoholic beverages only to countries where alcohol e-commerce shipping is legally permitted. Orders may be refused if local alcohol laws restrict delivery.

4. Returns & Refunds
4.1. Due to the nature of our products, we generally do not accept returns, as we cannot guarantee that wines have been stored under appropriate conditions after delivery.
4.2. If your order arrives damaged or incorrect, please contact us within 72 hours of delivery with photos as proof.
4.3. Refunds or replacements are issued at our discretion, in accordance with applicable consumer protection laws.
4.4. Nothing in these Terms affects any statutory rights that consumers may have under applicable law.
4.5. Refunds will be processed using the original payment method after the returned products have been received and inspected.
4.6. Customers are responsible for return shipping costs unless the product arrives damaged, is incorrect, or applicable consumer protection laws require otherwise.

5. Intellectual Property
5.1. All content on the Site, including images, text, and trademarks, is owned by Wines Underwater or licensed for use.
5.2. You may not copy, reproduce, or distribute any content without written permission.

6. Limitation of Liability
6.1. We are not liable for any indirect, incidental, or consequential damages resulting from the use of our products or site. 
6.2. Wines Underwater is not responsible for delays caused by external shipping partners.

7. Governing Law
7.1. These Terms are governed by the laws of of Spain.
7.2. Any disputes shall be resolved in the courts of Girona, Spain.
